Abstract

Land is a resource that plays a vital role in the lives of people and the state. To provide legal certainty regarding land ownership and rights, the government implements land registration, as stipulated in Law Number 5 of 1960 concerning Basic Agrarian Regulations (UUPA) and Government Regulation Number 24 of 1997 concerning Land Registration. Through land registration, communities are expected to obtain legal security for their land ownership. However, various problems are still frequently encountered in its implementation, one of which is the occurrence of duplicate certificates. Duplicate certificates occur when two or more certificates are issued for the same plot of land. This problem usually arises due to administrative errors, such as inaccurate checking of physical and legal data by officials, errors in land measurement and mapping, inconsistencies in archival data, and a suboptimal land data digitization system. As a result, overlapping land rights arise, which can lead to disputes, legal uncertainty, and losses for interested parties. This study aims to determine the factors that cause double certificates due to administrative errors in the land registration process and to analyze the legal impacts that arise this study examines procedural flaws in the issuance of these certificates. This study uses normative legal research methods with both legislative and conceptual approaches. The results are expected to provide an understanding of the causes and legal consequences of duplicate certificates and provide input for improving the land administration system to provide greater legal certainty and protection to the public.
